EB-3 Visa: Your Path to Permanent Residency in the U.S

The EB-3 visa, also known as the third preference employment-based visa, is a direct path for foreign nationals seeking permanent residency (green card) in the United States through employment opportunities. It is for skilled workers, professionals, and other workers who possess the necessary qualifications but may not meet the strict requirements of EB-1 or EB-2 visa categories.

What is EB-3 visa?

The EB-3 Visa is a U.S. employment-based immigration visa for skilled workers, professionals, and other workers. It requires a permanent job offer and labor certification. Skilled workers need at least two years of experience, professionals must have a bachelor's degree, and other workers can perform unskilled labor that is not temporary or seasonal.

Visa process

1 Labor Certification

The U.S. employer files a labor certification with the DOL, proving efforts to hire a qualified U.S. worker and showing the foreign hire won't affect U.S. wages or conditions.

2 I-140 Immigrant Petition

After labor certification approval, the employer files Form I-140 with USCIS to confirm the job offer and the worker's qualifications. It takes from 6 months to over a year.

3 Visa Application

Upon I-140 approval, the worker applies for a visa through consular processing abroad or status adjustment if already in the U.S.

Requirements

The specific requirements and documents needed for an EB-3 visa application will vary depending on the subcategory. However, some general requirements include:

  • A valid job offer in the U.S. from a U.S. employer
  • An approved labor certification
  • Proof of education and/or work experience relevant to the occupation
  • A valid passport
  • Medical examination report

Understanding EB-3 Processing Time

The processing timeline for an EB-3 visa can vary significantly depending on several factors, including the subcategory, current visa backlogs, and USCIS workload. Here's a general breakdown of the potential timeframe:

  • PERM Labor Certification (6–12 months): Include the duration for advertising the job, proving no qualified U.S. workers are available, and submitting the certification to USCIS.
  • I-140 Petition Processing(6-9 Months): Done after the approval of PERM Labor Certification from the DOL. This process takes 6-9 months (with premium processing in 21 days).
  • Visa Bulletin Priority Date Waiting (Varies): After I-140 approval, applicants wait for their priority date to be current, which varies by country and can take months or years, especially for India and China.
  • Adjustment of Status or Consular Processing (9-12 Months): Once the priority date is current, applicants can file Form I-485 if in the U.S. or go through consular processing abroad, with this step usually taking 9–12 months.
  • Work Authorization and Travel Documents (Optional, 3-5 Months): Applicants can apply for an Employment Authorization Document (EAD) and Advance Parole while waiting for their Green Card, a process that typically takes 3–5 months.
